Natural and manufactured stone and tile have variances and imperfections. Variations in shade, size, texture, caliber, dye lot, and appearance are inherent characteristics and are not defects. Samples, photographs, webpage images, and displays are for general reference only and do not guarantee an exact match. Batch or lot matching is not guaranteed unless confirmed by Seller in writing.
Buyer must inspect all material and report any claim for damage, shortage, or nonconformity at the time of pickup or delivery and, in any event, prior to cutting or installation. Use, cutting, fabrication, or installation constitutes acceptance of the material and a waiver of any claim that could have been discovered upon reasonable inspection by Buyer. Buyer assumes all responsibility for product selection and installation, including installation of any replacement materials.
SELLER MAKES NO EXPRESS WARRANTY. SELLER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR PARTICULAR PURPOSE. IN NO EVENT SHALL SELLER BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, AND SELLER’S TOTAL LIABILITY SHALL NOT EXCEED THE INVOICE AMOUNT PAID FOR THE SPECIFIC MATERIAL GIVING RISE TO THE CLAIM. Buyer assumes all responsibility for product selection and installation, including installation of any replacement materials.
All claims and return requests must be made within 15 days following receipt of the material and are subject to Seller’s prior written approval. All returned material must be unused, in its original packaging, and in the same condition in which it was received. No cut, painted, stained, sealed, glued, or installed material may be returned. All sales of special order and custom material are final and may not be returned. Buyer is responsible for all return freight, handling, and insurance. All approved returns are subject to a 20% restocking fee.
Material installed over a concrete slab should be mortared down. For sand set installations, high quality sand and crushed lime rock should be used as a base. Rectangular porcelain tile should be installed with staggered 1/3 offset to minimize the chance of lippage or bowing effect. Installation guidance is provided for convenience only – Buyer must use a qualified installer and follow applicable industry standards and manufacturer recommendations. Seller is not responsible for installation methods, substrate conditions, jobsite conditions, or workmanship.
All credit card payments are subject to a 3% credit card processing fee.
