Natural and manufactured stone/tile vary in shade, size, texture, caliber, dye lot, and appearance; such variations and imperfections are inherent and not defects. Samples and photos are for reference only. Exact match and lot matching are not guaranteed unless confirmed in writing. Buyer must inspect materials upon pickup or delivery and notify Seller of damage, shortage, or nonconformity before cutting or installation. Cutting, use, or installation constitutes acceptance and waives discoverable claims. SELLER MAKES NO EXPRESS WARRANTIES AND DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Buyer is responsible for inspecting and approving materials prior to installation and for ensuring that the product is suitable for the intended application. Seller is not responsible for installation methods or jobsite or substrate conditions. Buyer is responsible for identifying and disclosing any underground utilities, septic systems, drain fields, irrigation systems, or other concealed site conditions that may affect delivery or unloading. Seller and its delivery carrier may rely on delivery instructions provided by Buyer. Buyer shall identify any restricted delivery areas in advance or be present at the time of delivery to direct placement of materials. Seller is not responsible for damages arising from concealed site conditions or from delivery locations designated, directed, or approved by Buyer. Products are delivered to customers by an independent third-party. Seller is not responsible for any accidents, injuries, losses, delays, claims, or damages (including, without limitation, property damage) in connection with delivery, the acts or omissions of the third-party delivery company, or conditions at the delivery location or area. All claims and return requests must be requested within 15 days of receipt and require prior written approval. Approved returns must be received by Seller within 15 days of receipt of the material, unused, unaltered, and in original packaging with no cuts, sealer, grout, or stain. Special order sales are final. Buyer pays return freight and insurance plus 20% restocking fee. Risk of loss and responsibility for the material pass to Buyer upon delivery to Buyer or Buyer’s designated delivery location, regardless of whether delivery is performed by Seller or a third-party carrier.
SELLER’S TOTAL LIABILITY IS LIMITED TO THE PRICE OF THE MATERIAL. SELLER IS NOT LIABLE FOR CONSEQUENTIAL DAMAGE. Credit card payments incur a 3% processing fee.
